§ 9 Conclusion and performance of the Sales Agreement
- The Sales Agreement is concluded when the Seller confirms the acceptance of the Order by sending an e-mail to the address given by the Customer in the Order Form. The confirmation contains the essential terms of the Order; these Terms and Conditions are available in the Store at any time and can be saved or printed.
- The Customer must pay for the Order when placing it. If the payment is not completed within 2 calendar days, the Seller may cancel the Order; any amount already paid will be refunded.
- The Seller dispatches the Products within 5 business days of receiving the payment, usually sooner. The delivery time by DPD depends on the destination country.
- If an Order contains Products with different dispatch times, the longest dispatch time applies to the whole Order.
- The Customer will receive an e-mail when the Order has been dispatched.
§ 10 Right of withdrawal
- A Consumer may withdraw from the Sales Agreement within 14 days without giving any reason.
- The withdrawal period expires 14 days after the day on which the Consumer, or a third party other than the carrier indicated by the Consumer, takes physical possession of the Product. If the Order contains several Products delivered separately, the period starts when the last Product is received.
- To exercise the right of withdrawal, the Consumer must inform the Seller of their decision by an unequivocal statement, e.g. by e-mail to [email protected] or by post to the address given in § 3. The Consumer may use the model withdrawal form below, but this is not obligatory. To meet the deadline, it is sufficient to send the statement before the withdrawal period has expired.
- If the Consumer sends the statement by e-mail, the Seller will confirm its receipt without delay by e-mail.
- Effects of withdrawal:
- The Seller will refund all payments received from the Consumer, including the standard delivery costs (except for any additional costs resulting from the Consumer choosing a delivery method other than the cheapest standard delivery offered by the Seller), without undue delay and in any event no later than 14 days from the day on which the Seller is informed about the withdrawal.
- The refund is made using the same means of payment as used for the original transaction, unless expressly agreed otherwise; the Consumer will not incur any fees as a result of the refund.
- The Seller may withhold the refund until it has received the Products back or until the Consumer has supplied evidence of having sent them back, whichever is earlier.
- The Consumer must send back the Products to the address given in § 3 without undue delay and in any event no later than 14 days from the day on which they informed the Seller of the withdrawal. The deadline is met if the Products are sent back before the 14-day period has expired.
- The Consumer bears the direct cost of returning the Products.
- The Consumer is only liable for any diminished value of the Products resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
- The right of withdrawal does not apply to:
- sealed goods that are not suitable for return for health protection or hygiene reasons and were unsealed after delivery (this applies in particular to opened lash, glue and nail packaging),
- goods made to the Consumer’s specifications or clearly personalized.
- Model withdrawal form (complete and return this form only if you wish to withdraw from the agreement):

§ 11 Complaints and statutory warranty
- The Seller sells only new Products and is liable to Consumers for any lack of conformity of the Products with the Sales Agreement under the statutory rules (implementing Directive (EU) 2019/771). The Seller is liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery.
- If a Product is not in conformity with the agreement, the Consumer may request its repair or replacement and, where the law provides for it, a price reduction or termination of the agreement.
- Complaints can be submitted by e-mail to [email protected] or by post to the address given in § 3. To help us handle the complaint quickly, please describe the problem, attach photos if possible and give your order number.
- The Seller will respond to a complaint without undue delay and no later than within 14 days of receiving it.
- If the Seller asks for the Product to be sent back as part of the complaint, it should be sent to the address given in § 3; in justified cases the Seller covers the cost of sending it back.
§ 12 Out-of-court dispute resolution
- If a problem cannot be resolved directly with the Seller, Consumers can obtain free advice and help with cross-border disputes from the European Consumer Centre in their country (ECC-Net): https://commission.europa.eu/live-work-travel-eu/consumer-rights-and-complaints/resolve-your-consumer-complaint/european-consumer-centres-network-ecc-net_en.
- Consumers may also turn to the out-of-court dispute resolution bodies and consumer protection authorities of their country of residence. Participation of the Seller in such proceedings is voluntary unless required by law.
- This does not affect the Consumer’s right to bring a claim before the competent court.
§ 13 Personal data
- The controller of the personal data provided by the Customer in the Store is the Seller.
- The Seller processes the data in order to conclude and perform the Sales Agreement (Article 6(1)(b) GDPR), to fulfil its legal obligations, in particular in accounting and tax matters (Article 6(1)(c) GDPR), and on the basis of its legitimate interest in establishing, exercising or defending claims (Article 6(1)(f) GDPR). With the Customer’s consent, the data may also be used for marketing purposes (Article 6(1)(a) GDPR).
- To deliver the Order and process the payment, the Seller shares the necessary data with the carrier (DPD) and the payment service provider (PayPal).
- Providing personal data is voluntary, but the data marked as required in the Order Form are necessary to conclude and perform the Sales Agreement.
- The Customer has the right to access, rectify and erase their data, to restrict processing, to data portability, to object, and to lodge a complaint with a supervisory authority. Details are set out in the Privacy Policy: https://winkbeauty.eu/privacy-policy/.
§ 14 Final provisions
- Agreements concluded through the Store are concluded in English.
- The Seller may amend these Terms and Conditions for important reasons, in particular changes in the law or in the available payment or delivery methods. Customers with an Account will be informed of any amendment at least 7 days before it takes effect. Amendments do not apply to Orders placed before they take effect.
- Agreements concluded through the Store are governed by Polish law. For Consumers, this choice of law does not deprive them of the protection afforded by the mandatory provisions of the law of the country in which they have their habitual residence.
- Nothing in these Terms and Conditions excludes or limits the rights that Consumers have under mandatory provisions of law.
