Terms and conditions of the promotion "We refund for your order"

§ 1. GENERAL PROVISIONS

The organizer of the promotional action “We refund for the order” (hereinafter referred to as the “Promotion“) is Awesome Brandz spółka z ograniczoną odpowiedzialnością with headquarters in Wrocław, Stanislawowska 47 , NIP 8943191302, KRS 0000982871, REGON 522617989 (hereinafter referred to as the “Organizer“).
The organizer is the promisor of the prize within the meaning of Article 919 et seq. of the Civil Code.
The promotion is organized for the period from 05/04/2025 with no specific end date.
The promotion is conducted on the territory of the Republic of Poland.
It is not the intention of the Organizer or the purpose of the Promotion to hinder the access to the market of other entities offering services or products corresponding in kind to the services or products covered by the Promotion (hereinafter referred to as “Other Entities“), in particular, the rules of participation in the Promotion and the terms and conditions of winning prizes are not in any way dependent on the number of services or products of Other Entities that the Participant purchases – both during and after the Promotion.
The Organizer reserves the right to make changes to the Terms and Conditions, provided that this does not impair the terms of participation in the Promotion, and the changes will not affect important aspects of participation in the Promotion. Any changes to the Terms and Conditions will be announced 3 days in advance via the website available at winkbeauty.pl (hereinafter referred to as the “Promotion Website“), a message sent to the e-mail address referred to in section 3.2 of the Terms and Conditions, as well as in the Organizer’s office.
The Promotion includes all products from the Organizer’s offer (hereinafter referred to as “Products“), offered for sale during the Promotion.
Entities that meet the conditions set forth in these Terms and Conditions, including acceptance of its provisions, shall participate in the Promotion (hereinafter referred to as “Participant” or “Participants“).

§ 2 CONDITIONS OF PARTICIPATION IN THE PROMOTION

The Promotion is addressed to: natural persons of full legal age residing in the territory of the Republic of Poland, having full legal capacity, not running a business activity, who purchase the Organizer’s Products / conclude an agreement for the provision of the Organizer’s Services as consumers within the meaning of Article²²¹ of the Civil Code;
Providing data, including personal data, related to the Promotion is necessary to participate in the Promotion.
Employees of the Organizer, as well as family members of the listed persons, may not participate in the Promotion. Family members are understood as: ascendants, descendants, siblings, spouses, spouses of siblings, parents of spouses, cousins and persons in an adoption relationship.

§ 3 JOINING THE PROMOTION AND CONDITIONS OF THE PROMOTION

Only a person who:
1. meets the conditions referred to in Section 2.1, subject to the provisions of Section 2.3. Regulations;
2. Joined the Promotion by:
  1. purchase on the Promotion Website during the Promotion.
  2. publishing a video on your Instagram or TikTok profile about the purchased products
  3. Achieve at least 2,000 impressions on at least one profile
  4. email contact with a link to the published video and the order number to the Organizer’s email address: [email protected]

2. email contact with a link to a qualifying publication implies agreement to enter the Promotion and acceptance of the Terms and Conditions.

(3) A person joining the Promotion must acquire displays for his publication organically, without using paid promotions.

(4) Entry into the Promotion shall be confirmed by sending an electronic message to the Participant’s e-mail address provided to the Organizer in the Entry Form.

5 The Promotion consists in the fact that Participants receive a prize (hereinafter referred to as the “Prize”) in the form of a refund for products purchased on winkbeauty.co.uk during the Promotion, which were then shown in a publication on the Participant’s Instagram or TikTok profile and reached the number of organic impressions listed in the Terms and Conditions.

(6) The maximum amount of the refund is PLN 200 gross, taking into account the shipping costs of the order.

7 The following conditions must be met in order for the purchase of the Organizer Products/ to be considered as having occurred:

1. 1. making a purchase during the Promotion (the date on the receipt or VAT invoice is decisive);
  2. timely payment of the purchase. Timely payment for the Products shall be understood as payment made within the time limit resulting from the sales document (indicated as the due date). The date on which the amount due is credited to the Organizer’s account is decisive.

8 Participants may not transfer the right to obtain the Prize to third parties.

(9) If there is any doubt as to whether the Participant has met all the requirements contained in these Regulations, the Organizer shall have the right to withhold the issuance of the Prize until the Participant demonstrates that he or she has met all the requirements contained in these Regulations.

10. the Participant may participate in the Promotion once, unless he/she contacts the Organizer and the parties agree otherwise.

§4 COMPLAINT PROCEDURE

Complaints about the course of the Promotion may be submitted in writing to the address Narcyzowa 1, 55-002 Dobrzykowice and by email to [email protected] during the Promotion and within 7 days from the date of the end of the Promotion, with the annotation Promotion “We refund for the order – complaint”. The deadline for filing a complaint is determined by the date the complaint reaches the Organizer’s address.
Only the Promotion Participant has the right to file a complaint regarding the conduct of the Promotion.
A written complaint should include: Participant’s name, mailing address, e-mail address as well as a detailed description and indication of the reason for the complaint.
Complaints will be considered by the Organizer within 14 days of their receipt by the Organizer, based on these Regulations.
The Participant will be notified of the decision on the complaint by registered mail or by e-mail sent to the Participant’s address provided in the complaint within 14 days from the date of the Organizer’s consideration of the complaint.

§5 FINAL PROVISIONS

The content of these Regulations shall be made available to all potential Participants at the Organizer’s office and on the Promotion Website. The rules of the Promotion shall be determined solely by these Regulations and by mandatory provisions of law. All promotional and advertising materials related to the Promotion are for informational purposes only.
Participation in the Promotion is voluntary, taking part in the Promotion implies acceptance of the provisions contained in these Regulations.
The personal data of the Participants (persons representing the Participant) will be processed by the Organizer (personal data controller) in order to participate in the Promotion “We refund for the order”, including in particular the issuance of Prizes and processing of any complaints, as well as for the promotion, advertising and marketing of Wink Beauty products and services.

The basis for the processing of personal data by the controller is the controller’s legitimate interest in marketing the controller’s own products (goods and services) and the possibility of conducting the Promotion in accordance with these Regulations [Article 6(1)(f) RODO].
Provision of data by the Participant is voluntary. In case of failure to provide data for the purposes of participation in the Promotion, Participant’s participation in the Promotion will not be possible. Lack of the Participant’s consent to receive communications of a marketing nature will make it impossible to send information about product offers (goods or services) attractive to the Participant.
The Participant (the person representing the Participant) has the right to access the data, to request rectification, deletion or restriction of data processing, as well as to object to data processing.
If the Participant (the person representing the Participant) believes that the data is being processed in an inappropriate manner, the Participant has the right to file a complaint with the supervisory authority (President of the Office for Personal Data Protection).
The Participant’s personal data will be transferred to the Organizer’s business partners – providers of services needed to conduct the Promotion, as well as entities providing IT support for the Promotion and courier companies.
The data of the Participant (the person representing the Participant) will be processed by the personal data controller for the period of participation in the Promotion. After that time, the data will be processed only for the period and to the extent permitted by law, in particular, until the expiration of the statute of limitations for the Participant’s claims against the Organizeraza
